- Drivers beware: New rules
sure to deprive your rights
Check out Bill 52, Motor Vehicle Amendment Act No.2 - 2012.
Wait until the motoring public finds that they're going to lose
their right to a trial if they receive a police issued ticket, but
apparently still get penalty points.
If these "tribunals" operate anything like the parking ticket
ones, there will be a lower standard of proof. The legislation
also appears to penalize only B.C. drivers in terms of losing
their right to a trial; out of province and foreign license holders
are not subject to the to the new tribunals; presumably they
would receive a standard ticket and be entitled to have a trial
before a judge.
The current government has also given B.C. Transit the ability
to set up special "courts" to remove the right of users to dispute
their tickets before a judge or ask for a reduced fine.
We seem to be on some sort of slippery slope here. How far can
we go in terms of depriving citizens of their right to ask a judge
to rule on a matter versus a government appointee?
