I have a '91 super exceed with 1/2 your mileage but with most of the same goodies ie. Plantdrive it, full service, hitch, nice stereo... If I was to advertise it for sale on Craigslist for $14000 would that help you? Bonus for me if it sells then I get to start all over again!

Thanks for the offer, it might help, but I doubt it. I've shown this guy stock higher mileage CC Auto van's going for between $12,000 and $14,000 and he still insists that it is worth about $9,000. We'll see though, still working away at it.

If you don't agree in the end do you not have the option to go to court? If so, and you represented yourself, and they have to get their legal dept. to look after it, it will cost them a fortune. It would seem that could be a factor in making them reassess their stance if you just tell them, 'I think a judge would see my side of the story more favourable than you are, so I want to let a judge be the final arbitor here, so we'll see you in court, please let me know what a suitable date would be for you".

I got that attitude after having to sit for many boring hours over many years in a courtroom to give evidence as part of my job. I noticed that judges can be very reasonable a lot of the time, probably moreso than the ICBC guy. So I did a similar thing once and it seemed to work very well, and in the end after I really got their attention with my apparent lack of fear and willingness to go to court, we didn't end up there anyway. But you do need to be willing to go there in the end if it comes to that. I would be prepared to go on the principle of fairness alone however because it seems to me that the insurance co's work partly on the principle of intimidating the claimant.

Just find out first, that if you do go to court and lose. I believe you are stuck with all the court costs. Not sure, but worth looing into first.

You are if you go to Supreme Court to dispute an injury claim and lose. However you can go to Small Claims Court for claims up to $25,000.00 without that risk and without a lawyer. Lots of info on it on various websites, as well there is a bunch of info on what to do if you are not happy with your adjuster. One thing I saw was they recommend you ask to deal directly with the manager if you cannot reach a solution with your adjuster.

My part time ICBC certified adjuster has made it clear in his last two e-mails that he's passed the offer by the Material Damages supervisor and that he agrees with the adjuster. I'm not sure that means he won't deal with me, but I'm pretty sure after the last e-mail I sent to my adjuster that he's done discussing the issue with me. It took me an hour to research and compose, but it was cathartic, if somewhat futile. It just burns me up when the adjuster starts spewing 1/2 truths and general fear mongering about my beloved Delica.

It's possible that he did run it by his manager, but what slant did he put on it? The manager has probably not seen anything from your side of things only "this yahoo expects us to pay out thousands more than his vehicle is worth"

YOU need to talk to the supervisor, not have the problem adjuster do it for you.

I've been CCing all e-mail correspondence to my contact at ICBC, as this guy is an independent contractor. So the manager will have access to our discussion, whether or not he's read it is another story. At least I still have it on this end if I need to send it to him to bring him up to speed.

I agree the "my supervisor agrees with me" is probably a line he's cultivated over the last 35 years of being a used car saleman, so I've taken it with a large grain salt.

Well talking with the supervisor upped the offer anther $500 to $9,500 not including tax rebates. The next step would be arbitration whihc cost both ICBC and myself $300 each to do. I'm not sure who the actual arbiter would be, but it is outside of ICBC and it is binding. I figured the most I could hope to get would be $10,500, so it doesn't seem worth it to risk $300 for a possible gain of $700.

Bad news is they won't let me buy the van back, but I am able to strip the aftermarket parts including the Plant drive kit and trailer hitch.

If you're that close to an agreement, meet them 1/2 way and tell them that is your final price.

If they don't budge, then tell them you are prepared to wait as long as it takes and you are not concerned at all about keeping the claim open for the upcoming months.

If it's down to under a grand, then they are better off closing the claim instead of keeping it open at that point.

I'm not sure CCAutos is a "wrecker". I know they pull apart the vans they bring in for parts, but other than that...

Anyway, I agree with the others: strip out the aftermarket stuff (the stereo, the hitch and the PlantDrive) 'cause ICBC simply won't pay you for them, and then toss them the keys. I think you're getting about as much as you can out of them, and only that because you held on for more than a month. Sounds like you played quite the game of brinksmanship and you've gained some ground.
